Return and Exchange Conditions

Kaizen Jiu-Jitsu Brand

These return and exchange conditions apply to orders through the online shop Kaizen Jiu-Jitsu Brand.

1. Principle: no voluntary right of return

As the products of Kaizen Jiu-Jitsu Brand are items from small series, limited production quantities or specially developed brand products, there is generally no voluntary right of return and no entitlement to a refund, unless there is a legally recognised defect.

All sales are final, to the extent permitted by law.

We are happy to help with size selection. However, responsibility for the final size choice lies with the customer.

2. No right of return for change of mind

In particular, there is no right of return or refund in the case of:

  • incorrect choice of size;
  • change of mind after purchase;
  • dislike;
  • subjectively differing perception of fit;
  • incorrect colour expectation due to screen display;
  • late ordering;
  • a product no longer desired;
  • orders of limited items or small series;
  • reduced goods, sale items or promotional goods, to the extent permitted by law;
  • refusal of acceptance or an uncollected shipment.

Statutory rights in the case of justified defects remain reserved.

3. Exchange for a different size

An exchange is possible solely as a goodwill gesture and only for a different size of the same item, provided the desired size is available.

An exchange for a different product, a different colour, a different item or a refund of the purchase price is excluded, unless there is a justified defect.

Conditions for an exchange:

  • written notice within 7 calendar days of delivery by email to KaizenJiu-Jitsu@pm.me;
  • prior written confirmation by Kaizen Jiu-Jitsu Brand;
  • item unworn, unwashed, unused and free of odour;
  • item in flawless original condition;
  • original tags still on the item;
  • original packaging fully present;
  • no soiling, hair, animal hair, deodorant marks, sweat marks, make-up marks, washing marks or signs of use;
  • no damage, deformation or alteration to the item;
  • return within the period stated in the exchange confirmation.

Items that do not meet these conditions are excluded from exchange.

4. Items excluded from exchange

Excluded from exchange are in particular:

  • worn items;
  • washed items;
  • soiled items;
  • damaged items;
  • items with odour or sweat, deodorant, make-up, washing or use marks;
  • items without original tags;
  • items without original packaging;
  • personalised or custom-made products;
  • reduced goods, sale items or promotional goods, to the extent permitted by law;
  • gift cards, vouchers or digital products;
  • products that cannot be resold for hygiene reasons.

Kaizen Jiu-Jitsu Brand reserves the right to inspect returned items and to refuse an exchange if the condition does not meet the above requirements.

5. Process of a size exchange

The following process applies to a possible size exchange:

  1. Send a request
    Within 7 calendar days of delivery, send an email to KaizenJiu-Jitsu@pm.me with the following details:
    • order number;
    • full name;
    • ordered item;
    • size currently received;
    • desired new size;
    • brief reason;
    • photos of the unworn item with visible tags, if requested.
  2. Wait for confirmation
    Please do not return any item without prior written confirmation. After your request has been reviewed, you will receive a return address and, if applicable, a reference number.
  3. Return the item
    The item must be returned in original condition, with original tags and original packaging.
  4. Inspection upon receipt
    After the return has been received, the item is inspected.
  5. Shipping of the exchange size
    If all conditions are met and the desired size is available, the exchange size is shipped after payment of any shipping costs.

An exchange is only processed after the return has been received and successfully inspected.

6. Costs and risk for returns

For returns, the customer bears all costs and risks in full, to the extent permitted by law.

These include in particular:

  • return postage;
  • shipping insurance;
  • tracking costs;
  • packaging costs;
  • renewed shipping costs for the exchange goods;
  • import duties;
  • export duties;
  • customs fees;
  • sales tax, VAT, import VAT or comparable charges;
  • brokerage fees;
  • handling fees of shipping service providers;
  • storage fees;
  • fees due to incorrect or incomplete customs information;
  • costs due to refusal of acceptance;
  • costs due to uncollected shipments;
  • costs for renewed delivery attempts;
  • any loss of value of the goods.

The return is made entirely at the customer's risk.

Kaizen Jiu-Jitsu Brand accepts no liability for lost, damaged, delayed, misrouted or customs-blocked returns.

We strongly recommend sending returns with tracking and adequate insurance.

7. International returns

For returns from abroad, the customer is solely responsible for the correct customs declaration.

International returns must be correctly declared as returned goods. Incorrect or incomplete customs declarations may lead to additional costs, delays or rejection of the shipment.

All resulting costs are borne entirely by the customer.

Returns sent cash on delivery, unfranked, without tracking or with outstanding customs, tax, import or shipping costs will not be accepted.

Should Kaizen Jiu-Jitsu Brand incur customs fees, import costs, taxes, handling fees or other costs due to an international return, these may be passed on to the customer or offset against any claim.

8. Availability of the exchange size

An entitlement to exchange exists only if the desired size is available at the time of processing.

A prior request does not guarantee a reservation, unless the reservation has been expressly confirmed in writing.

Should the desired size not be available, the following options are available at the choice of Kaizen Jiu-Jitsu Brand:

  • return of the original item to the customer, shipping costs at the customer's expense;
  • issue of a voucher of the corresponding value, provided Kaizen Jiu-Jitsu Brand expressly offers this;
  • alternative goodwill solution by individual agreement.

There is no entitlement to a refund unless there is a legally recognised defect.

9. Condition of the return and refusal of exchange

Kaizen Jiu-Jitsu Brand inspects every return upon receipt.

If it is found that the item has been worn, washed, damaged, soiled, altered or not returned in full, the exchange may be refused.

In this case, the customer may choose whether the item should be returned at their own expense.

If the item is not requested back within the period communicated by the seller, or the renewed shipping costs are not paid, Kaizen Jiu-Jitsu Brand reserves the right to deal further with the item after a reasonable period, to the extent permitted by law.

10. Defects and damaged goods

Justified defects in the goods are to be distinguished from a voluntary exchange due to an incorrect size.

A defect exists in particular if a product has a significant production fault upon receipt or does not correspond to the ordered item.

Defects must be reported in writing by email to KaizenJiu-Jitsu@pm.me within 7 calendar days of receipt.

The report must contain:

  • order number;
  • full name;
  • description of the defect;
  • photos of the affected item;
  • photos of the packaging, if relevant;
  • photo of the shipping label, if relevant.

In the case of justified defects, Kaizen Jiu-Jitsu Brand will, at its choice, provide:

  • rectification;
  • replacement delivery;
  • voucher;
  • refund;
  • another appropriate solution.

In the case of justified defects, Kaizen Jiu-Jitsu Brand bears the reasonable return costs, provided the return was confirmed in advance and is made according to the instructions.

Unannounced returns are not automatically refunded.

11. No defect

In particular, there is no defect in the case of:

  • incorrect choice of size;
  • subjectively perceived deviation in fit;
  • slight colour deviations due to screen display;
  • minor production-related deviations in print, embroidery, seams, material structure or placement;
  • natural wear;
  • damage due to training, sparring, friction, mat contact or hook-and-loop fasteners;
  • damage due to improper use;
  • damage due to incorrect care;
  • damage due to washing contrary to the care instructions;
  • damage due to dryer, heat, bleach, aggressive detergents or chemical cleaning;
  • development of odour or material change through use;
  • damage by third parties or shipping service providers after handover of the goods, to the extent permitted by law.

12. Transport damage

Visible transport damage should be reported directly to the carrier and documented photographically.

Please send us an email within 7 calendar days of delivery with:

  • order number;
  • photos of the damaged packaging;
  • photos of the shipping label;
  • photos of the damaged item;
  • a brief description of the damage.

Without timely documentation, clarification with the shipping service provider may be difficult or impossible.

13. Refusal of acceptance and uncollected shipments

Refusal of acceptance or non-collection of a shipment does not constitute a proper return.

If a shipment is returned due to refusal of acceptance, non-collection, an incorrect address, lack of cooperation, unpaid customs fees or unpaid import duties, the customer bears all resulting costs.

These include in particular:

  • original shipping costs;
  • return shipping costs;
  • customs fees;
  • import and export duties;
  • handling fees;
  • brokerage fees;
  • storage fees;
  • renewed shipping costs;
  • any loss of value of the goods.

Any refund amount is reduced by all costs incurred, to the extent permitted by law.

14. US and international customers

For orders from the United States of America and other international markets, these return and exchange conditions apply unless mandatory statutory provisions state otherwise.

Kaizen Jiu-Jitsu Brand generally does not offer voluntary returns due to change of mind, incorrect size choice or dislike.

The customer is obliged to review these return and exchange conditions before completing the order.

To the extent that mandatory consumer rights in the respective state of residence may not be excluded, these rights remain reserved.

15. Relationship to GTC and shipping conditions

These return and exchange conditions supplement the General Terms and Conditions and the shipping conditions of Kaizen Jiu-Jitsu Brand.

In the event of contradictions, the mandatory statutory rights of the customer take precedence. Otherwise, the conditions published in the online shop at the time of the order apply.
